Carriage of Goods by Sea

Well, now that the new week has started, the stress is kicking in!


During the past few days, I went to google and websites to find out more about the course modules that I am doing in Block 2.


One of those that I have read through is the Bill of Lading and the Charterparties, which i would assume important in the Carriage of Goods by Sea..
Perhaps it is good for us to know a little bit about the basic information in this module?

At the beginning i find it really boring. Oh well, I guess it is a rather dull field in terms of reading when contrasted to the crash of collision cases or the rough and the tumble of personal injuries,or the drama of ship disaster? 



Basically, charterparties and Bill of Lading( BOL) is the most fundamental chapter in the Maritime Law, in particular of carriage of goods.
Each clause means a thousand, and involves litigation if it is not interpreted carefully. 


Charter Parties are generally divided into three, (i) Voyage (ii) Time and (iii) Demise.
These three groups impose different standards and terms for the cargo, in terms of time, capacity, and the control over the shipping or the ship itself.At this point, the breaches of any of the three brings different effect to the charterparties and the cargo owner too.


Bill of Lading, on the other hand, is A legal document between the shipper of a particular good and the carrier detailing the type, quantity and destination of the good being carried. The bill of lading also serves as a receipt of shipment when the good is delivered to the predetermined destination. This document must accompany the shipped goods, no matter the form of transportation, and must be signed by an authorized representative from the carrier, shipper and receiver.  


Generally, the dispute cases arose from CharterParties and BOL are ruled under the International Convention- The Hague Rules, Hague-Visby Rules, Hamburg Rules or Rotterdam Rules, depends on which is appropriate depending of the matter or the facts of the case.
