Facebook Copyright Infringement

Facebook is my everyday routine. Whenever I'm free from my work I'll log into my Facebook and check out those updates and videos which shared by my friends. This afternoon, I logged into Facebook just like the usual days, however what makes it different today is I so happen to find some nice songs from Youtube and i decided to share it on Facebook. Right after sharing that piece of video, i started to wonder, am i infringing copyright by just clicking the 'share' button provided on the Youtube page?

People would probably said I'd been thinking too much because since Youtube has provide us an easy way to share video to Facebook, it shouldn't be a problem.

*there's a bar of button where Youtube user could easily share the video to other website such as blogger , Facebook and etc.


Nevertheless, I did some little research in this matter. From hubpages.com, it says that by providing a link to a Youtube video (or share the link on Facebook) can never infringe copyrights because infringing video should not have been on the Youtube in the first place. Youtube itself is well-shielded as it is against their policy to host any infringing video on the site and all infringing video will be removed once it is reported. Furthermore, most users are just 'sharing' the videos and they are not the ones who uploaded it, they did not do anything wrong.

Other than that, it is worth noticing that Youtube will not be liable for any copyright infringement in their user's uploaded video. This was held in a recent decided case from Spain (Spain: YouTube not liable for users' upload)

However, matters could be held another way if an 'embedded video' is concerned. According to hubpages.com, having an embeded image or video on your website, you must first obtain permission from the owner unless the image is a public figure. The second way will be citing all the sources as to where you get these images from by attributing all the images back to the original site.

As to those Facebook user who infringes copyright, the Facebook administrator will send you a notification like this:-



Just a friendly reminder to all, be more cautious when you are going to embed images.
